I am ALL for people being allowed to do what they want once they buy a vehicle, and have done it many times myself on cars over the years.īut I suppose if they prove they own that SW they also have every right to deny any warranty work. I am unsure at this time as to the extant of who or where these laws are being used, but its a chance I am unwilling to take right now until the copy write infringement stuff is settled. If you bring it into the dealer for routine service and they find it hacked they CAN snatch the ECU per some of these lawsuits because the SW legally still belongs to them and its been hacked. I was thinking this would be the way to go, and it still may be if you are out of warranty. So it ends up not being a warranty issue unless they can prove it ran way to lean or rich and screwed something up. Using a controller OTOH is NOT modifying the ECU but the signals coming out of it. And from what I have seen doing some research this is very legal for them to do. Yamaha denied the claim because the ECU was running a non-factory profile. So this guy said when he took his bike in for warranty issues. It seems it is a highly modified crack as far as the company is concerned. It seems the discussion led to how these folks are getting their 'licenses' to do that then, because Polaris is not doing that for anyone I am aware of. The EPA is also considering fines for the mods as well to tuners and owners that do that. ![]() They went after the tuners first.Īfter more research I found that car and tractor dealers ( John Deere up front ) have pending suits that say the software inside the ECU is proprietary and anyone caught screwing with it can be sued.
